LOS ANGELES (AP) ? A judge ruled Monday that a man charged with stalking Halle Berry should stand trial on two charges filed after he was repeatedly seen on the actress' property earlier this year.

Los Angeles Superior Court Judge Melissa Widdifield issued her ruling after hearing from two witnesses called during a preliminary hearing to show some of evidence against Richard A. Franco, who has pleaded not guilty to burglary and stalking charges.

He was charged after police arrested him outside Berry's home in July after he was seen on the property three times in three days.

Los Angeles police Detective John Gregozek testified that when Franco was caught, he was carrying a key to Berry's guesthouse, where the Oscar-winning actress has her beauty salon and some of her wardrobe.

Gregozek said Franco apparently obtained the key on July 10, when he entered the house for about 20 seconds after Berry left the salon area to go to her kitchen. Franco was standing outside her kitchen door when Berry spotted him and locked the door and called police.

Berry did not attend the hearing, but Gregozek told the judge the actress is still afraid of Franco.

The following night, after Berry had hired private security, Franco was seen climbing over the actress' gate and coming onto her property. Joseph Vach, a retired California Highway Patrol officer, was working as private security and helped detain Franco. The man was carrying a notebook that included references to Berry and entering her home, Vach testified.

Franco, who was dressed in a jail jumpsuit, will remain jailed on $150,000 bail, Widdifield ruled. He returns to court on Oct. 31 for arraignment.

Berry obtained a civil restraining order against Franco after his arrest. "This person has invaded and trampled upon the most fundamental sense of security I have, and I am extremely frightened of him and what he might do to me or those I love," she wrote in her July petition.

Cellphone cos. to warn as plans approach limit

(AP) ? Cellphone companies pledged Monday to warn subscribers before they go over their monthly limits for calling minutes, text messages and data use.

The pledge comes in response to a threat of regulation by the Federal Communications Commission, which wants to curb nasty surprises in the monthly bills of wireless subscribers.

CTIA ? The Wireless Association, a trade group representing the major cellphone companies, said they're also promising to warn subscribers that they're paying roaming fees if they travel abroad.

The warnings will arrive as text messages, and subscribers won't need to sign up for them ? they'll arrive automatically. CTIA said its member will have warnings in place on at least half their plans in a year and all of them in two years.

AT&T Inc. and Verizon Wireless, the two largest carriers, already provide text-message warnings on their data plans, but not on text messaging or calls. Instead, subscribers have to look up their usage data.

The announcement was made jointly by the CTIA and the FCC, which credited Consumer's Union, the publisher of Consumer Report, for raising awareness of the issue. The magazine had found that many of its subscribers had been startled by high monthly bills.

Curbing occasional high bills is unlikely to have much of a financial effect at phone companies. Analyst Michael McCormack at Nomura Securities noted that the companies say that only a few percent of their subscribers exceed their allotments in a month. The trend over the past few years of making calls to other cellphones "free," or not counting toward the plan limits, has reduced the number of people who go over on calling minutes, he said.

Phone companies are also moving away from charging for each text message or selling "buckets" of 500 messages per month. Rather, they have moved toward offering unlimited text messaging.

The biggest remaining "bill shock" problem for consumers may be in international data roaming, McCormack said. Someone who travels abroad with a smartphone might use it sparingly for calls, but be unaware that apps are using data in the background, racking up big fees that only become apparent when the bill arrives.

The alerts are voluntary for the phone companies, but FCC Chairman Julius Genachowski made it clear that the agency would step in if companies fail to police themselves.

Kathleen Grillo, senior vice president for federal regulatory affairs at Verizon Communication Inc., said the voluntary approach was preferable because things change quickly in the wireless world and regulations don't always keep up.

"The result is an industry code that will serve consumers better than rules that would soon be outdated," she said.

Asked at the press conference why it would take two years to fully implement the warnings, CTIA President Steve Largent said phone companies have to reconfigure their systems.

Thousands emerge for MLK memorial dedication (AP)

WASHINGTON ? Thousands of people spanning all ages and races honored the legacy of the nation's foremost civil rights leader during Sunday's formal dedication of the new Martin Luther King Jr. Memorial in Washington.

Aretha Franklin, poet Nikki Giovanni and President Barack Obama were among those who attended the more than four-hour ceremony. King's children and other leaders spoke before the president, invoking his "I Have a Dream" speech and calling upon a new generation to help fully realize that dream.

The crowd, some of whom came out as early as 5 a.m., included people of all ages and races. Some women wore large Sunday hats for the occasion.

The president arrived late morning with his wife and two daughters, which drew loud cheers from those watching his entrance on large screens.

Cherry Hawkins traveled from Houston with her cousins and arrived at 6 a.m. to be part of the dedication. They postponed earlier plans to attend the August dedication, which was postponed because of Hurricane Irene.

"I wanted to do this for my kids and grandkids," Hawkins said. She expects the memorial will be in their history books someday. "They can say, `Oh, my granny did that.'"

Hawkins, her cousin DeAndrea Cooper and Cooper's daughter Brittani Jones, 23, visited the King Memorial on Saturday after joining a march with the Rev. Al Sharpton to urge Congress to pass a jobs bill.

"You see his face in the memorial, and it's kind of an emotional moment," Cooper said. "It's beautiful. They did a wonderful job."

A stage for speakers and thousands of folding chairs were set up on a field near the memorial along with large TV screens. Most of the 10,000 chairs set out appeared to be full. Many other people were standing.

The August ceremony had been expected to draw 250,000, though organizers anticipated about 50,000 for Sunday's event.

Actress Cicely Tyson said her contemporaries are passing the torch to a new generation and passed the microphone to 12-year-old Amandla Stenberg. The girl recalled learning about the civil rights movement in school and named four young girls killed in a 1963 church bombing in Birmingham, Ala.

"As Dr. King said at their funeral, `They didn't live long lives, but they lived meaningful lives,'" Amandla said. "I plan to live a meaningful life, too."

About 1.5 million people are estimated to have visited the 30-foot-tall statue of King and the granite walls where 14 of his quotations are carved in stone. The memorial is the first on the National Mall honoring a black leader.

The sculpture of King with his arms crossed appears to emerge from a stone extracted from a mountain. It was carved by Chinese artist Lei Yixin. The design was inspired by a line from the famous "I Have a Dream" speech in 1963: "Out of the mountain of despair, a stone of hope."

King's "Dream" speech during the March on Washington galvanized the civil rights movement.

King's older sister, Christine King Farris, said she witnessed a baby become "a great hero to humanity." She said the memorial will ensure her brother's legacy will provide a source of inspiration worldwide for generations.

To young people in the crowd, she said King's message is that "Great dreams can come true and America is the place where you can make it happen."

King's daughter, the Rev. Bernice King, said her family is proud to witness the memorial's dedication. She said it was a long time coming and had been a priority for her mother, Coretta Scott King, who died in 2006.

Bernice King and her brother Martin Luther King III said their father's dream is not yet realized. Martin Luther King III said the nation has "lost its soul" when it tolerates vast economic disparities, teen bullying, and having more people of color in prison than in college.

He said the memorial should serve as a catalyst to renew his father's fight for social and economic justice.

"The problem is the American dream of 50 years ago ... has turned into a nightmare for millions of people" who have lost their jobs and homes, King said.

The choir from King's historic Ebenezer Baptist Church in Atlanta was scheduled to sing.

The nation's first black president, who was just 6 years old when King was assassinated in April 1968 in Memphis, Tenn., will speak about the man he has said "gave his life serving others."

Giovanni read her poem "In the Spirit of Martin," and Franklin was to sing.

Early in the ceremony, during a rendition of "Lift Every Voice and Sing," the crowd cheered when images on screen showed Obama on the night he won the 2008 presidential election.

Obama, who credits King with paving his way to the White House, left a copy of his inaugural speech in a time capsule at the monument site. He said King was a man who "stirred our conscience" and made the Union "more perfect."

But the Rev. Al Sharpton said the dedication was not about Obama but the ongoing fight for justice. He called for people from around the world to walk through the stone of hope and emerge to see "the face that brought us from the back of the bus to the White House."

Ark. city finds quiet, hope after drug arrests

As rampant drug dealing and violent crimes crept into the isolated Mississippi River city of Helena-West Helena, people in town knew something was up. But few bothered calling for help as gunfire rang out near the historic streets lined with boutique shops and boarded-up buildings.

"What are the police going to do? Nine times out of 10, they're just going to look the other way," Bubba Sullivan said, echoing distrust voiced throughout town.

Officials say a four-year federal investigation, dubbed "Operation Delta Blues," revealed that mistrust may not have been entirely misplaced. Hundreds of law enforcement officers swarmed Helena-West Helena in the middle of the night last week and arrested dozens of people ? five of them law enforcement officers accused of taking bribes to ignore and sometimes assist drug traffickers who shipped marijuana, cocaine and other illegal drugs throughout Arkansas, Mississippi and Tennessee.

The FBI said the probe focused on corrupt officers dealing with criminals who, in some cases, were convicted murderers.

"For far too long, a small minority of individuals has taken over this community," Mayor Arnell Willis said.

Parts of Willis' city of 12,000 remain undeniably inviting. Past a valley bathed in green vines, people have converted Victorian-style mansions into bed and breakfasts. Advertisements on more than one building boast the best Coca-Cola in town. Banners promote the historic downtown drag that drew tens of thousands of tourists just this month for the famous King Biscuit Blues Festival.

But a few blocks away, broken panes of glass and crumbling buildings hint at the crime that's haunted this city in the Mississippi River Delta, where jobs are scarce and the poverty rate has climbed to 30 percent. Financial troubles have led the state to take over the local schools, twice. Eight killings have been reported this year.

Bill Brothers, 60, remembers wandering the neighborhood as a child, without making his parents fret. But Brothers, who buys and sells airplanes, said he has been far more cautious raising his three sons.

"It's gotten where it's not uncommon" to hear gunshots, he said. "It's not something you'd be startled about anymore."

Willis, who took over the mayor's office in January, said he couldn't go to church on Sundays without hearing from people worried about killings and corruption. So just months into the job, he headed to Little Rock to beg U.S. Attorney Christopher Thyer for help.

"To be honest, I got tired of hearing the question," Willis said. "Locally, we were doing all we could do."

Thyer didn't tell Willis during their three-hour meeting that his office already had been investigating for years. He also didn't tell the mayor that at least four area police officers and a sheriff's deputy allegedly had been taking $500 bribes to escort drug shipments through the city and use their authority to prevent arrests or prosecutions. Prosecutors say the deputy was caught on a wiretap referring to it all as "the good old boy system."

The officers, who have all pleaded not guilty, were among defendants listed in seven federal indictments unsealed last week that brought 184 charges against some 70 people. The main indictment alleges a drug trafficking operation directed out of Helena-West Helena "was responsible for the distribution of large quantities of cocaine, crack cocaine, marijuana" and other drugs in east Arkansas, Memphis, Tenn., and Clarksdale, Miss., along with other areas.

Local pawn shop owner Vance Kalb III said he often would see and hear flashes of gunfire on the overnight security camera videos he watches every morning.

"We all feel like it can't get any worse, but it always does," Kalb said. "There's a lot of things that don't even show up in the newspaper."

When he came into work the morning after last week's busts, Kalb saw on the video flashes of emergency lights and heard arrests being made. The tapes were much quieter the rest of the week.

Kalb has tried to stay positive after bust, even designing several T-shirts celebrating the operation. One shirt pokes fun at defendants' nicknames listed in the indictments ? "Ray Ray," "Cheeseburger," "The Mechanic" and "Pee Wee."

"You can't do nothing but laugh," Kalb said. "It's sad, but at the same time, I'm happy it happened."

Those arrested are being held in Little Rock, more than 100 miles away. People in Helena-West Helena say they're grateful for outside agencies' help, but can't help but wonder if they're only seeing a brief respite from the noise and violence.

"When they get out, what's going to happen?" asked Linda Walters, who drives a school bus. "Is the killing going to start all over again?"

Thyer and other law enforcement officials have said their investigation will continue, though they won't comment on their next steps.

Residents, meanwhile, are coming out on their porches and yards again. For the first time many can remember, people say they have hope. Some are enjoying the silence.

Walters had grown accustomed to dropping from her bed and hiding on the floor when she heard gunfire in the middle of the night.

"Ever since they shot at my house, I hadn't really gotten no rest," Walters said. "I didn't think anybody was going to do anything."

After last week's arrests, she said she got a good night's sleep.

(AP) ? Minnesota Rep. Michele Bachmann, a long-shot Republican presidential contender, signed a pledge Saturday to push for construction of a fence along the entire length of the border with Mexico, raising the issue of illegal immigration in an Iowa town where about one third of the residents are Hispanic.

Bachmann also renewed her attacks on the immigration policies of Gov. Rick Perry of Texas, one of her rivals for the Republican nomination, and she criticized President Barack Obama for what she called his failure to control the border.

"President Obama has failed the American people by failing to secure the southern border," said Bachmann. "I will secure that border and that will be job one."

Bachmann's call for increased border security was made in a town where the meatpacking industry has drawn immigrant workers. Thirty-two percent of the town's 9,800 residents are Hispanic.

Van Hipp Jr., head of Americans for Securing Our Border, said Bachmann was the first Republican presidential hopeful to sign the pledge, but he added the group plans to aggressively seek the support of others as well. The document binds Bachmann to support the construction of a double fence along the length of the U.S. border with Mexico by 2013.

"I have been saying this all through the campaign,' Bachmann said. "Now you have my word in writing."

She called control of the border a national security issue and said illegal immigration costs the U.S. more than $100 billion a year. At the same time she rejected suggestions that talking about cracking down on illegal immigrants is racist or anti-Hispanic.

"It's OK to talk about this issue," said Bachmann. "Some say it's not OK to talk about this subject because that somehow means we are prejudiced or bigoted or biased against Hispanics. That's not what I hear form the people of Iowa. They are tired of paying for other people."

Hipp said the pledge was intended to insure that action is taken on the issue. "For too long, too many politicians have given only lip service to the war on our border," he said. "The rule of law has been ignored and the federal government has been derelict in its duty in defending our borders."

Cracking down on illegal immigration has become a major theme in the Republican race, with most of the candidates charging that Perry isn't tough enough on the issue.

Perry has taken a lot of heat for Texas' policy of allowing the children of illegal immigrants to pay lower in-state tuition rates to attend public colleges. Bachmann raised the issue again Saturday. "In 2009 in Texas there were 12,138 students that benefited from that," she said. "That cost the taxpayers of Texas $25.9 million."

Bachmann congratulated Hipp's group for injecting the immigration issue into the campaign, calling it a "wonderful gift."

She said that an alleged Iranian plot to launch a campaign of bombing and assassination in the U.S. would have involved people slipping across the border illegally. "This is not just an economic issue, this is also a national security issue. It's an issue dealing with terrorism."

Bachmann argued that it will be virtually impossible to cut into the nation's jobless rate until illegal immigration is reduced.

Bachmann told reporters she chose the town of Perry for signing the pledge because of its demographics. Asked if she chose Perry because it is the namesake of a leading opponent in the race, she said: "I thought about that too."

Reversing smoke-induced damage and disease in the lung

By studying mice exposed to tobacco smoke for a period of months, researchers have new insight into how emphysema and chronic obstructive pulmonary disease (COPD) develops. In the October 14th issue of Cell, a Cell Press publication, they also report a promising new way to reverse the lung damage underlying these conditions.

"It has not been very clear what causes the disease and there has been no therapy to stop or reverse lung destruction in emphysema," said Norbert Weissman of the University of Giessen Lung Center in Germany. "There have really been no new concepts about therapy in the last 20 years."

It's not for lack of interest, he said. In fact, COPD, including chronic bronchitis and emphysema, is expected to become the third-greatest cause of death worldwide by the year 2020.

In addition to airway inflammation and decreased of respiratory function, COPD is often accompanied by pulmonary hypertension, which is essentiallyhigh blood pressure in the lungs. Whether this condition was a cause or a consequence of COPD was not known.

Now, with powerful mouse models of COPD, Weissman and colleagues provide evidence that changes to the pulmonary blood vessels and the development of high blood pressure precede the development of emphysema. They further trace those effects to an inducible form of an enzyme known as nitric oxide synthase (iNOS), which catalyzes the formation of nitric oxide.

Nitric oxide (NO) and the nitric oxide system are important for opening up blood vessels and maintaining vascular tone, Weissman said. When nitric oxide levels grow too high, however, the molecule can undergo a chemical reaction forming aggressive peroxynitrite.

"Simply put, peroxynitrite can modify protein functions, leading to the destruction of lung tissue," Weissman said.

It appears this is exactly what happens in the development of emphysema. Mice lacking the iNOS enzyme were protected from both emphysema and pulmonary hypertension. Importantly, existing pharmacological agents can block iNOS activity, and mice treated with one of these drugs were protected from COPD-like changes to their lung vasculature. Treatment with the inhibitor also successfully reversed the course of the disease in the mice.

"For reversal of emphysema, you need active restructuring of the lung," Weissman said, noting that there is more work to do to explore the pathways involved.

The iNOS inhibitor used in these studies has already been used in clinical trials with apparently no major side effects, Weissman says. He and his team plan to pursue use of the drug as an inhaled therapy, with the hope that it may reach therapeutic concentrations only where it is needed
