Islamist politics rages in sun-kissed Maldives, India worried (Lead)

The dramatic transfer of power in the Maldives has ripped the mask off a placid tourist paradise with sun-drenched beaches and global jetsetters. Behind the veil is brewing a heady mix of Islamisation and politics that also has India worried.

"The Islamist parties stoked resentment against the Nasheed government and tried to discredit him as anti-Islamic. Islamists ganged up with the disgruntled sections of the police, the military and the opposition to engineer a coup," Ahmed Shaheed, Maldives former foreign minister and a key aide of Nasheed, told IANS over the phone from Male.

Ahmed Naseem, who succeeded Shaheed and was foreign minister till last week when Nasheed resigned amid a police mutiny, has also blamed the Islamists for the coup in the Maldives, a 100 percent Sunni Muslim nation. Naseem incurred the wrath of hardline opposition last year when he became the first senior Maldivian diplomat to visit Israel.

In fact, on the day Nasheed resigned amid a coup, a group of vandals destroyed priceless Buddhist statues and artefacts from the pre-Islamic era, considered idolatrous by hardline Islamic salafists, in the National Museum in the capital Male, an assault that was reminiscent of the the Afghan Taliban's destruction of priceless Buddha statues at Bamiyan in 2001.

In the weeks before opposition protests became more strident after the arrest of a judge at the behest of Nasheed, the tussle between the moderate, modernist Islam and the radical hardline version came to the fore when the Nasheed government was forced to order the closure of spas in hundreds of luxury resorts.

On Dec 30, a statement from the president's office said: "The government has decided to close massage parlours and spas in the Maldives, following an opposition-led religious protest last week calling for their closure."

The order followed concerted protests led by the opposition Adhaalat, or Justice Party, seen as an offshoot of Egypt's Muslim Brotherhood movement, and several rag-tag groups that accused the Nasheed government of compromising Islamic principles and wanted a strict adherence to strict Islamic law. The protests are now referred to as the 'Dec 23 revolt'.

In fact, the protesters demanded prohibition of the sale of alcohol in the island resorts and shut down of massage parlours which they accused were a front for prostitution. Alcohol is forbidden in the capital Male but is available at the luxury island resorts catering to upmarket tourists.

Calling for a return to conservative Islam, the protesters had also demanded demolition of monuments gifted by other South Asian countries at the 17th SAARC summit in Addu island.

It's not clear how the new dispensation led by Mohammed Waheed Hassan will shape up and what role the Islamists will get to play in the new power structure or the new national government of unity.

For now, it appears that the Islamists will wield considerable clout. Mohamed Jameel, the newly appointed home minister who had gone to a religious high school in Pakistan, is known to have a hardline Islamist posture. Last month, his party issued a pamphlet claiming that empty bottles of alcohol were found in the presidential offices and accused the government of planning to sell land to Israel. Many of seven new cabinet members announced the new president are known to have pro-Islamist sympathies.

"Islamist organisations and Islamist media outlets have proliferated in the public sphere. Their influence in the political society and the state has increased," said Azim Zahir, a Maldivian analyst.

The trend towards Islamisation in the Maldives, located strategically at the crossroads of vital sea lanes of communication, has India worried as it fears that if it is not checked the island nation could become a staging post for radical extremists.

What had added to New Delhi's anxiety is that many Maldivians have for the past few years been going to madrassas (traditional seminaries) in Pakistan and then return as radicals. In 2010, nine Maldivians were arrested in Pakistan's South Waziristan where they were training with al-Qaeda and Taliban elements.

In the only terror attack on Maldivian soil in 2007 when 12 tourists were injured in a blast in central Male, the masterminds are said to have escaped to Pakistan.

India is closely watching the unfolding situation and is buttressing its intelligence gathering to ensure that the country does not slip into the trap of fundamentalists.

On September 17, 2011 a small group of people gathered in New York to begin a protest that would soon turn into a non-violent revolution with people around the world joining in. The protest was staged to bring attention to that 1% in the nation that hold most of the country's wealth gained through collusion with state and national government and the back breaking labor of the other 99% of the American citizens who have sweated for generations to further line the pockets of big business.

It wasn't a shift in power that brought about the OWS (occupy wall street) protests. It was the recession that gave most Americans and indeed, the citizens of the world, a look into the true economic function of this country. For the first time, Americans saw first hand how these big companies greed lead us to financial disaster and while the average citizens of the country were losing their homes and their jobs, the government was busy giving handouts to these companies so they could give their wealthy CEOs bonuses for bringing our country to it's knees.

For the first time Americans saw the connection between government and big business and how the two have endeavored to ensure that the haves have more and the have nots have less. At first, many in the country were shell shocked by the recession and all eyes turned to the new president to make things right and to establish justice for those who needed it most. But, slowly they opened their eyes to the fact that nothing was going to change; that the government and big business were mated for life and nothing short of a revolution would change America's economic system.

At first, individual communities dealt with the economic crisis and the realization that neither business nor the government carried about the plight of the average person, by banding together and trying to help each other survive. But, finally shock was replaced with anger and the desire to see change a real change in the economic situation of this country. The Occupy Wall Street movement is the result of American' eyes finally being opened to the very real equality that has existed for generations and the need to shift the balance of power back to the American people where it belonged.

Now that the collective eyes of America and the world has been opened there is no going back. The Occupy Wall Street protest is just a beginning. If the Government is unable and unwilling to break their ties with the 1% of the population who have profited from the sweat of the common man, then the average citizen must make the changes themselves. They must shift the axle of power by learning to support the small local business turning their backs on the banks, and big business. If that means learning to grow their own food again, bartering for services, then so be it.

Unless and until the Occupy Wall Street protest can convince the America people to turn their backs on the very businesses that turned their backs on the American people, then nothing will change. The OWS protest will have brought attention but, little else to to their cause. And if nothing changes, then more people will lose their jobs, their homes, until finally the 1% will fail because they have bleed America and the American people dry and like every other parasite they too will die simply because they have no host of people to keep feeding their greed and their financial nests.

Copyright and Privacy in the Hong Kong and Australian Legal Regime

Graham Greenleaf, Faculty of Law, University of New South Wales, has published IP, Phone Home: The Uneasy Relationship between Copyright and Privacy, Illustrated in the Laws of Hong Kong and Australia at 32 Hong Kong Law Journal 35 (2002). Here is the abstract.

The author argues that privacy's relationship to copyright is that the right to experience intellectual works in private - free from surveillance - is part of the public domain aspect of copyright works (in Boyle's terms) or the creative commons (in Lessig's terms).

The development of content-protection technologies (CPT) and digital rights management systems (DRMS), despite their benefits to rights holders, pose many dangers to the protection of privacy, which some have said could mean an end to the privacy of reading. Hong Kong and Australia are two of the earliest jurisdictions in the world with laws implementing the anti-circumvention and rights management information (RMI) protection provisions arising from the WIPO Copyright Treaty 1996 (WCT). They are also two of the few jurisdictions outside Europe with privacy (data protection) laws applying to the private sector. These two jurisdictions, therefore, give two of the best illustrations of the tensions now arising between copyright and privacy: property versus privacy. In this article, the author explores how CPT and DRMS affect privacy, how existing data protection and privacy laws affect the operation of CPT and DRMS, and whether laws against copyright circumvention devices and interference with RMI prevent privacy protection. The author concludes that privacy could now be unduly prejudiced in favour of property, and suggests reforms which may help restore the balance. The first decision on the Australian provisions, Sony v Stevens [2002] FCA 906, also indicates that the Courts may also be interpreting anti-circumvention provisions narrowly, avoiding some of their dangers to privacy.

NEW YORK (AP) ? Mike Trang likes to use his iPhone 4 as a GPS device, helping him get around in his job. Now and then, his younger cousins get ahold of it, and play some YouTube videos and games.

But in the past few weeks, there has been none of that, because AT&T Inc. put a virtual wheel clamp on his phone. Web pages wouldn't load and maps wouldn't render. Forget about YouTube videos ? Trang's data speeds were reduced to dial-up levels.

"It basically makes my phone useless," said Trang, an Orange County, Calif. property manager.

The reason: AT&T considers Trang to be among the top 5 percent of the heaviest cellular data users in his area. Under a new policy, AT&T has started cutting their data speeds as part of an attempt to manage data usage on its network.

So last month, AT&T "throttled" Trang's iPhone, slowing downloads by roughly 99 percent. That means a Web page that would normally take a second to load instead took almost two minutes.

AT&T has some 17 million customers with "unlimited data" plans that can be subject to throttling, representing just under half of its smartphone users. It stopped signing up new customers for those plans in 2010, and warned last year that it would start slowing speeds for people who consume the most data.

What's surprising people like Trang is how little data use it takes to reach that level ? sometimes less that AT&T gives people on its "limited" plans.

Trang's iPhone was throttled just two weeks into his billing cycle, after he'd consumed 2.3 gigabytes of data. He pays $30 per month for "unlimited" data. Meanwhile, Dallas-based AT&T now sells a limited, or "tiered," plan that provides 3 gigabytes of data for the same price.

Users report that if they call the company to ask or complain about the throttling, AT&T customer support representatives suggest they switch to the limited plan.

"They're coaxing you toward the tiered plan," said Gregory Tallman in Hopatcong, N.J. He hasn't had his iPhone 4S throttled yet, but he's gotten text-messages from AT&T, warning that he's approaching the limit. This came after he had used just 1.5 gigabytes of data in that billing cycle.

John Cozen, a Web and mobile applications designer in San Diego, hasn't been throttled yet either, but he's been so disturbed by a warning that he's "almost scared to use the phone," he said. Complaining to AT&T got him nowhere, and now he's looking to switch to another carrier.

"I don't think two to three gigabytes is an exorbitant amount," he said. "Really, I'm just looking at pictures and text once in a while."

AT&T spokesman Mark Siegel said that as of last summer, the top 5 percent of data users were using 2 gigabytes of data per month. But he also said the company doesn't actually throttle all of the top 5 percent "unlimited" data users. Last month, the figure was only 0.5 percent, or about 200,000 people, he said.

That's because AT&T only throttles users in areas where the wireless network is congested that month, Siegel said.

Siegel also pointed out that aside from moving to a tiered plan, "unlimited" plan users on the cusp of being throttled can use one of AT&T's 30,000 Wi-Fi hotspots, where usage is unmetered.

The unlimited plan worked fine for AT&T a few years ago, when the iPhone was new. The company had ample capacity on its network, and wanted to lure customers with the peace of mind offered by unlimited plans. Now, a majority of AT&T subscribers on contract-based plans have smartphones, and the proportion is growing every month. That's putting a big load on AT&T's network.

But AT&T's approach to managing data congestion differs from that of the other phone companies. Verizon Wireless doesn't slow down the "5 percent" unless the cell tower their phone is connected to is congested at that moment, and it slows them down by the minimum amount necessary. By contrast, once AT&T has decided to throttle your phone, it will be slow for the rest of the billing cycle, even if it's 3 a.m. and there are no other cell phones competing for the capacity of that particular cell tower.

Verizon's measures have drawn few complaints, and indeed, may have gone unnoticed even by the "5 percent."

T-Mobile USA is up front about the level it starts throttling at: 5 gigabytes. AT&T subscribers have no idea if they might be among the top 5 percent until they get the warning, which is soon followed by throttled service. While Trang was throttled at 2.3 gigabytes, he knows other iPhone owners who are using 5 or 6 gigabytes per month with impunity.

"It seems very random," Trang said.

Sprint Nextel Corp. is hanging on to unlimited data plans without throttling, alone among the "Big Four" national wireless carriers.

Tallman sees few prospects for a lawsuit against AT&T. The company is still providing unlimited data usage to throttled customers, even if the speeds are so low as to make the phone useless for anything but phone calls and text messages. The company made no promises that "unlimited" data would always be coupled with high speeds, he notes.

"They just guaranteed the highway. They didn't guarantee the speed limit," he said.
